Beginning at a point on the northern right of way of Merion Way which point is located 269.49 feet as measured easterly and southeasterly along the northern right of way of Masters Way; run thence north 07 degrees 25 minutes 03 seconds east along the original western boundary of Lot B 38 a distance of 243.77 feet to a point; run thence north 83 degrees 34 minutes 28 seconds east along the original northern boundary of Lot B 38 a distance of 124.10 feet; run thence south 01 degrees 43 minutes 24 seconds west a distance of 185.98 feet to a point run thence south 06 degrees 01 minutes 33 seconds west a distance of 103.76 feet to the original southeastern corner of Lot B 38 run thence in a westerly direction along the northern right of way of Merion Way an arc distance of 34.23 feet (such arc being subtended on its northern side by a chord bearing north 77 degrees 58 minutes 42 seconds west and being 34.22 feet in length continue thence north 75 degrees 53 minutes 50 seconds west along the northern right of way of Merion Way a distance of 108.10 feet to the point of beginning.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
